1. Agreement
These Terms of Service ("Terms") govern your access to and use of the Mantele Media website at mantelemedia.com, the Mantele Media internal dashboard at dashboard.mantelemedia.com, and any related services (collectively, the "Services") provided by Mantele Media ("Mantele Media," "we," "our," or "us").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. Use of the Services
You may use the Services only in compliance with these Terms and all applicable laws. You agree not to:
- Use the Services in any manner that could damage, disable, overburden, or impair them;
- Attempt to gain unauthorized access to any portion of the Services, other accounts, or any systems or networks connected to the Services;
- Use any automated means to access the Services without our prior written consent;
- Reverse engineer, decompile, or disassemble any portion of the Services;
- Use the Services to violate the rights of others or any applicable law or regulation.
3. Third-Party Platforms
Our internal dashboard connects to third-party advertising platforms, including TikTok Ads Manager and Meta Ads Manager, through official APIs. When you authorize us to access your account on any such platform, you grant us permission to read and manage campaign data on your behalf, strictly for the purpose of operating your campaigns under the terms of our engagement.
Your use of those third-party platforms is governed by their respective terms of service. We are not responsible for changes to third-party platforms or their policies that affect your campaigns.
4. Client Engagements
Separate written agreements govern paid engagements between Mantele Media and our clients. In the event of a conflict between these Terms and a signed client agreement, the signed agreement controls with respect to that engagement.
5. Intellectual Property
The Services, including all content, features, and functionality (text, graphics, logos, software, and the arrangement thereof), are owned by Mantele Media or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent, except as expressly permitted in these Terms.
6. Confidentiality
We treat client data, campaign performance information, and any non-public information shared with us in the course of an engagement as confidential. We do not disclose client-specific information without the client's written consent, except as required by law.
7. Disclaimers
The Services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Services, including any warranties of merchantability, fitness for a particular purpose, or non-infringement.
Advertising performance is inherently variable. We do not guarantee specific advertising outcomes, including but not limited to reach, impressions, clicks, conversions, cost per acquisition, or return on ad spend.
8. Limitation of Liability
To the maximum extent permitted by law, Mantele Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of the Services.
Our total liability for any claim arising out of or relating to the Services shall not exceed the amount you paid to us in the twelve months preceding the claim, or $100 USD, whichever is greater.
9. Indemnification
You agree to indemnify and hold harmless Mantele Media and its officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
10. Termination
We may suspend or terminate your access to the Services at any time, with or without cause and with or without notice. You may discontinue use of the Services at any time. Sections of these Terms that by their nature should survive termination will survive, including without limitation intellectual property, confidentiality, disclaimers, limitation of liability, and governing law.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of laws principles. Any disputes shall be resolved in the state or federal courts located in Florida.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms here and update the "Last updated" date above. Your continued use of the Services after a change constitutes acceptance of the revised Terms.
